The Technical Building Inspection, better known by its acronym ITE, is a technical control to which buildings in some Spanish cities must submit from time to time.
The ITE is a type of preventive legal maintenance, by which the buildings are periodically subjected to the revision of a series of elements that affect the security of the property and the people who inhabit it.
The ITEs are regulated by Royal Decree-Law 8/2011 of July 1 and by the different Municipal Ordinances, which determine the conditions for inspections. Royal Decree-Law 8/2011 establishes the following in relation to ITE:
“Article 21. Obligatory nature of the technical inspection of buildings.
1. Buildings older than 50 years, unless the Autonomous Communities set different dates in their regulations, preferably for residential use located in the municipalities indicated in the third additional provision, must be subject, depending on their age, of a periodic technical inspection that ensures its good condition and due conservation, and that meets, at least, the following requirements:
a) Evaluate the adequacy of these properties to the legally enforceable conditions of safety, health, accessibility and decoration.
b) Determine the works and conservation works that are required to maintain the properties in the legally required state, and the time indicated for that purpose. If after the deadline for submitting the technical inspection report, the obligor has not carried out the inspection, the competent body will order the realization of the same, granting an additional term to present it, with warning, in case of non-compliance, of the imposition of coercive fines, subsidiary execution of the technical inspection and the initiation of the corresponding sanctioning procedure.
The amount of these penalties ranges between 1,000 and 6,000 euros, in addition to the amount derived from the subsidiary execution of the technical inspection at the expense of the obligor.
If there is opposition, from the owners or residents, to the practice of the inspection, the corresponding court order will be requested for the entry and execution of the technical inspection.
